Introduction

Welcome to OptiMeasure. Please read these Terms of Service ("Terms") carefully before using the OptiMeasure mobile application (the "App") operated by us.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. Use of the Application

A. License

We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on your Apple-branded products in accordance with these Terms and the App Store Terms of Service.

B. Acceptable Use

You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. Opticians and professionals using the App's CRM features are solely responsible for ensuring they have obtained proper consent from their clients before saving any measurement data.

2. In-App Purchases and Subscriptions

The App offers premium features and an "Optician Elite" tier via auto-renewing subscriptions ("Subscriptions").

  • Billing: Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Management: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

3. Accuracy of Measurements

OptiMeasure utilizes advanced ARKit and TrueDepth camera technology to estimate facial metrics. While we strive for high accuracy, the results provided by the App are estimates and can be affected by environmental factors (lighting, angles, device hardware). We do not guarantee 100% accuracy and are not liable for any poorly fitted eyewear resulting from the use of this App.

4. Limitation of Liability

In no event shall OptiMeasure, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of OptiMeasure and its licensors. The App is protected by copyright, trademark, and other laws.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
